LAHORE (February 05 2010): A division bench
of the Lahore High Court (LHC) here on
Thursday disposed of various identical writ
petitions filed by Indus Sugar Mills and
others as notification pertaining to
fixation of minimum sugar cane price at 100
per 40Kg was not implemented.
The petitioners had challenged government's
Sugar Policy 2009- 2010 declaring that all
sugar mills in Punjab shall pay a minimum
price of sugar cane according to the sucrose
content of the sugar cane subject to minimum
of price of Rs 100 per 40kg after December
13, 2009. The petitioners' counsel barrister
Syed Ali Zafar contended before the court
that it was necessary for the Punjab
government to put in place mechanism and
systems for determination of sucrose
content. He said because the government had
not done so, the notification could not be
implemented.
Furthermore, it was not possible to
implement the notification as the sugar
canes' sucrose content could only be
confirmed at the end of production season.
The court required the Advocate General
Punjab and Deputy Attorney General to
confirm if the government has fulfilled the
requirements of the notification.
The Advocate General Punjab on Thursday
confirmed that the government had not yet
fulfilled the requirements of the
notification and it seems that the
government was not going to implement the
notification. The bench, therefore, disposed
of the petitions as the notification was not
to be implemented.
